German court orders domain registrar to suspend torrent site’s DNS

A German court has granted an injunction against domain registrar Key-Systems ordering them to cancel the registration of their customer’s domain H33T.COM, a torrent site. The injunction was sought by Universal Music. While Key-Systems argued that it was not responsible for the copyright infringement, the court ruled that the registrar had a duty to investigate after notification of infringing activity and had to take corrective action in case of “obvious violations”.

While several reports have described this as a finding of “liability” for the domain registrar, a blog posting by Universal’s lawyer Mirko Brüß only referred to the deletion of the domain name, with no suggestion of monetary damages being awarded.
